A will is one of the most important legal documents you will ever produce, and is the only way to ensure that your wishes are carried out and your estate is divided in the way that you choose. Before you make a will, it is worthwhile considering who you would like to include, or possibly exclude, in your will. There may be particular members of your family, friends, pets and charities that you would like to leave some, or all of your estate to.
A funeral plan allows you to cover your funeral director’s costs and make a contribution to third party costs, reducing the worry for loved ones at the time of need. Another reason that people choose to take out a funeral plan is to make arrangements in advance for their funeral. Usually this is not to plan elaborate details but to ensure their loved ones are not burdened by an ever-growing list of choices. For example even setting out whether you wish to be buried or cremated can be a huge relief for loved ones.
A Lasting Power of Attorney is a legal document that allows you to appoint one or more people to make decisions on your behalf during your lifetime. The people you appoint to manage your affairs are called the Attorneys. A Lasting Power of Attorney is a completely separate legal document to your Will although many people put them in place at the same time as getting their Will written, as part of wanting to plan for the future.
What would happen to your business if you lost the ability to deal with your own business affairs and make decisions? What if you have a business bank account in your name as a sole trader or joint bank accounts with other business owners which require the signatures of all the named account holders? Very few businesses consider the consequences of what could happen to their business, should, they or fellow Directors lose mental capacity through accident or illness.
